Sales Contract, Guarantees, and Buyer(s)/Seller Agreement
This Contract/Agreement is made by and between Cloyd Aussies and the Buyer(s), for a Breeding/competition Quality (Full Registration):

  1. We evaluate our puppies extensively from birth to weaning age, and even if we have the gender and color you request but we do not feel it is suitable for your intended purpose or family situation, we reserve the right to sell you a pup that will better suit your needs.
  2. To the best of the Sellers knowledge and ability, they have represented this dog/pup honestly and in accordance with the Australian Shepherd Club of America (ASCA) Breed Standard. However, it is sometimes difficult or impossible to tell at an early age how a puppy will turn out.
  3. This animal was in good health at the time of delivery, and health is guaranteed for a period of 3 days (72 hours) from the time of delivery. We highly recommend that you take the dog/pup to your veterinarian within this time period to verify that it is in good health.
  4. Sellers have properly socialized animal, treated for internal and external parasites, and given vaccinations applicable for its age.
  5. Sellers will furnish the following:
    1. Existing registration papers or an application for new registration for puppies that have not been previously registered
    2. Vaccination record
    3. Five generation pedigree
    4. Information concerning the breed and ASCA.
  6. Buyer(s) agrees to furnish the Sellers with a photocopy of permanent registration papers and to inform the Sellers of any titles or awards this dog/pup earns.
  7. The buyer(s) agree to maintain dog/pup on human grade pet food, meeting or exceeding Flint River Ranch (FRR) feeds (see Flint River Feed website for standards), for at least one year to ensure proper health, growth, and well-being of the dog/pup (unless dog/pup is being shipped overseas or out of the continental US)
  8. Buyer(s) may, at own expense, return the dog/pup within thirty days (30) for any reason whatsoever. If the dog/pup is in good physical and mental condition, half the purchase price will be refunded minus any veterinarian expenses because of accident, neglect or mistreatment that occurred while the dog/pup was in the Buyer(s) possession and/or wellness check.
  9. Sellers and Buyer(s) realize that sometimes situations change and unforeseen circumstances arise. If at any time you find that you are unable or unwilling to properly care for the animal, you agree to return it to us. We have the right to rescue this dog/pup if we find that it is being mistreated, neglected, or abused and you do not voluntarily return it. Also, any mistreatment, neglect or abuse of the animal automatically voids all guarantees given by us.
  10. Buyer(s) agrees that if this dog/pup is offered for sale or trade at any time in the future, it will first be offered to us.  If the dog/pup is being sold it will be offered to us at a purchase price not to exceed the original purchase price for non-titled dog/pups.  If the dog/pup has acquired titles buy back price will be determined on a case-by-case basis.  A determination will be made within forty-five (45) days whether or not we wish to purchase the dog/pup.
  11. Buyer(s) breeding practices will be conducted in accordance with ASCA breeders Code of Ethics. (Copy provided.)
  12. Australian Shepherds are not to be bred before appropriate health checks are completed at two years of age, i.e. Hips, eyes, and blood (when required).  Buyer(s) will assume responsibility for all medical expenses involved in these procedures.
  13. If this is a male, Seller reserves up to three (3) free breedings to bitches owned or Co-Owned by us for a period not to exceed 7 years. It shall be our responsibility to deliver the bitch to the dog.  If the bitch is owned and housed by Cloyd Aussies at the time of whelping, stud owners will have the option of receiving a pup from one of the litters at no charge.  Buyer(s) will be responsible for the shipping costs and materials needed to deliver the pup to their location.
  14. If this is a merle Australian Shepherd, male or female, Buyer(s) agrees that any homozygous ("merle white", "lethal white", or lethal merle) puppies which result from its breeding will be culled with in one week after birth. You further agree that under no circumstances will you allow these puppies to be either sold or given away.
  15. Because this animal is sold as breeding quality and with full registration. It is guaranteed to be free from the following:
    1. Hip Dysplasia - The dog/pup's hips must be x-rayed and given a rating of “fair”, “good”, or “excellent” by the Orthopedic foundation for Animals (OFA) before it is bred, (or equal rating with Penn Hip) or before the age of 28 months, whichever should come first.  Sellers reserve the right to request a second set of x-rays and resubmission to OFA before a final determination is made (at our expense).
    2. Eye Defects - We guarantee this animal to be free from hereditary or congenital eye defects that render it unsuitable for breeding. If a defect is found, we require that you furnish us with a signed statement from a veterinarian who is also a Diplomat of the AmericanCollege of Veterinary Ophthalmologists, stating exactly what the defect is, whether it is hereditary, congenital, or acquired, and that the animal should not be used for breeding because of it. This guarantee is valid until the dog/pup reaches 24 months of age or until it is bred, whichever comes first. Ocular defects caused by accidents that occur after Buyer(s) receives the animal are not covered under this guarantee.
    3. Hereditary or Congenital Defects - This animal is guaranteed to be free from hereditary or congenital defects that render it unsuitable for breeding (Examples: hemophilia, epilepsy, heart defects).  Buyer(s) must provide the Sellers with a signed statement from a licensed veterinarian stating exactly what the defect is, whether it is hereditary, congenital or acquired, and that the dog/pup should not be used for breeding because of it.
    4. If during the exams for the above health concerns the dog/puppy passes away, an autopsy should be performed to determine cause of death. If an autopsy is not performed a replacement pup will not be granted.
    5. The guarantees contained in item # 15 apply only until the animal is bred. Once bred, you are implying that you are satisfied that the animal is free from all defects, and the guarantees are void.
  16. Should circumstances listed in Items “1” through “3” above arise the Sellers and Buyer(s) shall reach an agreement as to whether the dog/pup shall be:
    1. Spayed or neutered and retained by buyer.
      1. Replacement pup possible if all other contractual requirements have been met.
    2. Returned to the Sellers or Sellers representative with appropriate registrations,
      1. Buyers will be responsible for transportation to the Sellers desired location.
    3. Spayed or neutered and placed in another home (home must be approved by Sellers);
    4. Euthanized.
      1. While euthanizing is not something we like to do, if a circumstance should arise such as extreme health problems, this may be the best solution for the animal.
    5. Upon written proof that the animal has been spayed, neutered, or euthanized, or after it has been returned to the Sellers, we will replace it with one of equal or better quality as soon as one is available.
    6. In the case of euthanization, the animals’ registration papers are to be returned to the Sellers.
    7. If a replacement pup is to be granted Buyer(s) will be responsible for all shipping costs.
  17. Sellers require prior written notice before Spay, Neuter, or Euthanization and do not give refunds, exchanges, or replacements in cases without prior knowledge.
  18. According to the ASCA Breeders Code of Ethics the Buyer(s) agrees that no offspring from this Australian Shepherd will be sold in pet stores, puppy mills, or litter lots.
  19. The Sellers disclaim any and all other warranties and guarantees, whether expressed or implied, except those described above. The liability of the Sellers shall not, in any case, exceed the purchase price of this animal minus deposit.
  20. The guarantees given in this Contract will be honored only to the Buyer(s) listed in this Contract, and are not transferable to subsequent owners.
  21. Registration and Registered Name of dog/puppy:
    1. Puppy will be able to be registered with ASCA and AKC
    2. You are allowed up to 30 characters in a dog/pups registered name including spaces.
    3. We require our Kennel name to be included in the dog/pups registered name.
  22. Payment, questionnaire, and shipping requirements:
    1. A Non-refundable Deposit of $50.00 must be received before puppy reservation is complete.
      1. If choice pup is not produced, based on most compatible personality, deposit can be applied toward a puppy from a future litter.
    2. Purchase price of puppy is $___________, plus shipping costs if applicable (see “4” below)
      1. Payment arrangements can be made, but registration papers will not be provided until dog/puppy is “Paid in Full.”
    3. Questionnaire must be completed and returned to Cloyd Aussies to ensure proper placement of puppy. If questionnaire is not completed Cloyd Aussies will select what it thinks is the best suited puppy for you.
    4. Shipping an 8 week old puppy will cost approximately $300.00 (subject to increase or decrease without notice).  All shipping costs are the Buyers responsibility.
    5. All shipping will be scheduled through Vagabond Hound.  This is an over the road animal transport company. Cloyd Aussies will do everything it can to accommodate the buyers schedule, but the puppy’s comfort and well-being will be our first consideration.
  23. If full payment of puppy and shipping has been received by buyer and circumstances arise that do not allow the buyer to accept the puppy, the price of the puppy will be applied to a future litter.
  24. This Contract is void unless properly executed by all parties. Buyer(s) must sign and return to the Sellers one (1) copy of the Contract before receipt of animal, or all guarantees are void.  All parties must initial any additions, deletions, or corrections to this Contract in order to be valid.  This Contract is a legally binding document, fully enforceable under the laws of the State of Nebraska.  All disputes will be handled in the County of Dawes, State of Nebraska.
